On June 25, 2025, the European Chemicals Agency (ECHA) released the updated Candidate List of Substances of Very High Concern (SVHCs). With the addition of 3 new substances, the total number of SVHCs on the list now stands at 250. This adjustment has significant implications for enterprises involved in the production, import, sale, and use of chemicals, which must strictly comply with relevant legal obligations to ensure compliance.

I. Details of the 3 Newly Added SVHCs

The 3 substances newly included in the list have clear definitions in terms of chemical properties, uses, and reasons for inclusion. The specific information is as follows:

No.Substance NameEC NumberCAS NumberReason for Inclusion (in accordance with REACH Regulation)Examples of Uses
11,1,1,3,5,5,5-heptamethyl-3-[(trimethylsilyl)oxy]trisiloxane241-867-717928-28-8Very persistent and very bioaccumulative (vPvB properties), in line with Article 57e1. Laboratory reagents; 2. Cosmetics and personal care products; 3. Perfumes and fragrances
2Decamethyltetrasiloxane205-491-7141-62-8Very persistent and very bioaccumulative (vPvB properties), in line with Article 57e1. Cosmetics and personal care products; 2. Lubricants and greases; 3. Automotive care products
3Tetra(sodium/potassium) 7-[(E)-{2-acetamido-4-[(E)-(4-{[4-chloro-6-({2-[(4-fluoro-6-{[4-(vinylsulfonyl)phenyl]amino}-1,3,5-triazine-2-yl)amino]propyl}amino)-1,3,5-triazine-2-yl]amino}-5-sulfonato-1-naphthyl)diazenyl]-5-methoxyphenyl}diazenyl]-1,3,6-naphthalenetrisulfonate; Reactive Brown 51466-490-7- (No CAS Number)Toxic for reproduction, in line with Article 57c1. Textile treatment products; 2. Dyes

II. Legal Obligations for Enterprises

Regarding the SVHCs on the list, EU regulations set clear compliance requirements for enterprises in different roles (suppliers, importers, manufacturers, etc.), which are specifically divided into the following four categories:

1. Product Information Transmission Obligation (for Suppliers)

If the concentration of an SVHC in a product exceeds 0.1% by weight, the supplier must provide sufficient information to customers and consumers to ensure the safe use of the product (such as usage precautions and risk prevention measures).

2. ECHA Notification Obligation (for Importers and Manufacturers)

  • Trigger Condition: For an importer or manufacturer, if the concentration of a specific SVHC in their product exceeds 0.1% by weight, and the annual production/import volume of this substance by the enterprise exceeds 1 ton.

  • Time Requirement: A formal notification must be submitted to ECHA within 6 months from the date when the substance is included in the SVHC Candidate List.

3. Safety Data Sheet (SDS) Provision Obligation (for Suppliers of SVHCs)

If a supplier supplies a substance from the SVHC Candidate List alone or supplies a mixture containing such a substance, they must provide a Safety Data Sheet (SDS) to the customer, specifying the physical and chemical properties, hazard information, protective measures, and emergency response methods of the substance.

4. SCIP Notification Obligation (for All Suppliers of Products on the EU Market)

In accordance with the Waste Framework Directive (Directive 2008/98/EC, WFD), since January 5, 2021, if the concentration of an SVHC in a product exceeds 0.1% by weight and the product is sold on the EU market, the supplier must submit a "Substances of Concern In articles as such or in complex objects (Products) (SCIP)" notification to ECHA.

  • Note: The SCIP database is an official platform established under the framework of the WFD, used to store information on "substances of concern in articles or complex products". It complements the "notification obligations for candidate list substances" and "supply chain information transmission obligations" stipulated in Articles 7(2) and 33 of the REACH Regulation, jointly improving the regulatory system for SVHCs.
